Our general terms and conditions under which we deliver items to you are described below. Please read them carefully before placing an order with us. These terms tell you everything you need to know when purchasing items from us.

  1. Who are we
    • We are IGOON, a company founded and registered in Nijmegen, the Netherlands. Our Chamber of Commerce number is 86902784.
    • How to contact us can be found on our Contact page . If we need to contact you, we will send an email to the email address you provided to us when placing your order.

  2. Applicability of these general terms and conditions
    • These general terms and conditions apply to every offer from the entrepreneur and to every distance contract and orders concluded between the entrepreneur and the consumer.
    • Before the distance contract is concluded, the text of these general terms and conditions will be made available to the consumer digitally on the entrepreneur's website or sent by email .
    • If one or more provisions in these general terms and conditions are wholly or partially null and void or annulled at any time, the remainder of the agreement and these terms and conditions will remain in force.
    • Situations that are not (any longer) regulated in these general terms and conditions must be discussed and assessed in consultation between the consumer and the entrepreneur 'in the spirit' of these general terms and conditions.
    • Any uncertainties regarding the interpretation or content of one or more provisions of our terms and conditions must be interpreted 'in the spirit' of these general terms and conditions.
  1. Our offer
    • We supply fitness clothing, including sports bras, tops, leggings and accessories.
    • If an item or discount has a limited period of validity or is subject to different conditions, this will be explicitly stated on the website and/or by email.
    • The offer is without obligation. The entrepreneur is entitled to change and adapt the offer.
    • The offer contains a complete and accurate description of the items and/or services offered. The description is sufficiently detailed to enable a good assessment of the offer by the consumer. The entrepreneur strives to provide the best possible truthful representation of the items and/or services offered.
    • Images of items are a true representation of the items offered. Entrepreneur cannot guarantee that the colors displayed exactly match the real colors of the items.
  1. Gift vouchers and discount codes
    • You can purchase and redeem a gift voucher ( in the form of a digital code ) from us in the same way as you would any of our other items, but:
      • you cannot buy a gift voucher using another gift voucher as a means of payment;
      • gift vouchers have no expiration date and are therefore valid as long as IGOON is active;
      • gift vouchers cannot be exchanged for money or returned;
    • Discount codes can be entered during the checkout procedure and automatically calculate the valid discount. NB:
      • Codes may be valid for a limited period or function as indicated in the relevant email or marketing communication and cannot be used outside that period.
      • Unless otherwise stated, codes can only be used on full-price items and are not intended for sale or discount items or to purchase gift cards.
      • Only one code can be applied per order. Codes cannot be used in conjunction with other offers.
      • Codes cannot be redeemed for cash and are not transferable.
      • Codes do not affect shipping costs.
      • We reserve the right to withdraw, amend or extend any offer at any time upon reasonable notice.
  1. Place an order
    • Orders are placed via the website igoon.nl . Once the consumer has added the desired item(s) to your shopping cart, they will go through a checkout process where they will need to enter their contact details, delivery and/invoicing details. The consumer checks the order carefully before placing the order to avoid disappointment.
    • The entrepreneur accepts payments via Visa, Mastercard, Maestro, Shop pay, American Express, PayPal, iDEAL, Google pay, and Apple Pay. If possible, consumers are also offered the option to make the purchase with Klarna Bank (AB) (publ.).
      • The availability of this option is subject to approval by Klarna. Please note that we reserve the right to withdraw or suspend this option with Klarna at any time.
      • In the event of non-payment by the consumer, the entrepreneur has the right, subject to legal restrictions, to charge the reasonable costs communicated to the consumer in advance.
    • Each consumer must be at least 18 years old and authorized to use the payment method chosen to pay for the items. If the consumer is under 18 years of age, an order may only be placed if a parent or guardian is involved.
    • The agreement is concluded after the consumer has placed an order and has received an email from the entrepreneur confirming that the order has been received. As long as receipt of this acceptance has not been confirmed by the entrepreneur, the consumer can terminate the agreement.
    • Every agreement is entered into under the conditions precedent of sufficient availability of the items in question. If it is not possible to deliver an item, the entrepreneur will contact the consumer and jointly find a solution.
  1. Dispatch
    • The entrepreneur will exercise the utmost care when receiving and executing orders for items and when assessing requests for the provision of services.
    • The entrepreneur strives to deliver items within 2 to 3 working days to the specified address or the collection point chosen by the consumer. All delivery times are indicative. The consumer cannot derive any rights from any stated periods. Exceeding a term does not entitle the consumer to compensation.
      • If the delivery of your items is delayed due to an event beyond the merchant's control (e.g. postal/courier delays, logistics or bad weather), you will receive a message in your mailbox.
      • If no one is able to accept delivery and the items do not fit in your letterbox, the courier will notify you of the attempted delivery and tell you where to collect your order or how to leave it to deliver
      • The entrepreneur offers optional order insurance to protect your order against loss by the courier. This means you are covered against any loss of your package during transport. Without order insurance, the entrepreneur is not responsible for the package after it has been handed over to the courier. However, the entrepreneur will do her utmost to provide support in the event of problems.

    • In the event of dissolution in accordance with paragraph 3 of this article, the entrepreneur will refund the amount paid by the consumer as soon as possible, but no later than within 14 days after dissolution.
    • The risk of damage and/or loss of items rests with the entrepreneur until the moment of delivery to the consumer or a representative designated in advance and made known to the entrepreneur, unless expressly agreed otherwise.
  1. Right of withdrawal
    • When purchasing items, the consumer has the option to terminate the agreement without giving reasons within 14 days. This cooling-off period starts on the day after receipt of the item by the consumer.
    • During the cooling-off period, the consumer will handle the item and its packaging with care. He will only unpack or use the item to the extent necessary to assess whether he wishes to keep the item. If he exercises his right of withdrawal, he will return the item to the entrepreneur with all accessories supplied and - if reasonably possible - in the original condition and packaging.
    • If the consumer wishes to exercise his right of withdrawal, he is obliged to inform the entrepreneur of this within 14 days of receipt of the item. The consumer must make this known via the return process on the website. After the consumer has indicated via the website that he wishes to exercise his right of withdrawal, the customer must return the item within 14 days. The consumer must prove that the delivered goods have been returned on time, for example by means of proof of shipment.
    • If, after the expiry of the periods mentioned above, the customer has not indicated that he wishes to exercise his right of withdrawal or has not returned the item to the entrepreneur, the purchase is a fact.
    • The entrepreneur can terminate the contract with the consumer if it is broken by the consumer. The consumer will be informed of this at the email address he provided. This possibility applies if the consumer does not provide information necessary for us to provide the items, for example the address for shipping, within a reasonable time of being requested; or when the consumer does not allow the items to be delivered within a reasonable period of time.
  1. Costs in case of withdrawal
    • If the consumer exercises his right of withdrawal, the costs of return ( if applicable ) will be borne by him.
    • If the entrepreneur owes the consumer an amount, the entrepreneur will repay this amount as soon as possible, and no later than within 14 days after receipt of the complete return.
      • For purchases paid for in part with a gift card, the refund will be applied to the gift card first.
      • If a discount code has been used by the consumer at checkout, the refund amount will be reduced to take into account the benefit of the discount received when purchasing the item.
      • If the order amount has exceeded an X amount and the consumer has therefore received 'free shipping', this amount will be deducted if the total value falls below this amount after returns.
  1. Exclusion of right of withdrawal
    • The entrepreneur can exclude the consumer's right of withdrawal for items as described in paragraphs 2 and 3. The exclusion of the right of withdrawal only applies if the entrepreneur has clearly stated this in the offer, at least in time before concluding the agreement.
    • Exclusion of the right of withdrawal is only possible for items:
      • items sealed for health protection or hygienic purposes (e.g. swimwear, underwear or socks) that have been unsealed upon receipt, or are not in their original packaging;
      • In the event that an item is damaged or missing a part before or upon return by the consumer.
  1. The price
    • The price (including VAT) of an item will be displayed on the order pages when placing an order.
    • The entrepreneur can adjust the price of an item at any time. If this is the case, the entrepreneur will adjust the price on the website to the most recent and correct price.
    • If the consumer placed an order for an item before the price change, the price will be as stated on the website at the time the order was placed and cannot be changed.
    • All prices are subject to printing and typographical errors. No liability is accepted for the consequences of printing and typographical errors. In the event of printing and typographical errors, the entrepreneur is not obliged to deliver the item at the incorrect price.
  1. Conformity and Warranty
    • Any defects or incorrectly delivered items must be reported to the entrepreneur in writing within 14 days of delivery. Returns of the items must be in the original packaging and in new condition.
    • The entrepreneur's warranty period corresponds to the manufacturer's warranty period. However, the entrepreneur is never responsible for the ultimate suitability of the items for each individual application by the consumer, nor for any advice regarding the use or application of the items.
    • The warranty does not apply if:
      • The consumer has repaired and/or edited the delivered items himself or has had them repaired and/or edited by third parties;
      • No claim can be made under the warranty:
      • in case of damage due to intent or negligence;
      • in case of improper use or negligent maintenance;
      • with normal wear and tear;
  1. Complaints procedure
    • The entrepreneur has a sufficiently publicized complaints procedure and handles the complaint in accordance with this complaints procedure.
    • Complaints about the execution of the agreement must be submitted fully and clearly described to the entrepreneur within 7 days after the consumer has discovered the defects.
    • Complaints submitted to the entrepreneur will be answered within a period of 14 days from the date of receipt. If a complaint requires a foreseeably longer processing time, the entrepreneur will respond within 14 days with an acknowledgment of receipt and an indication of when the consumer can expect a more detailed answer.
    • If the complaint cannot be resolved by mutual agreement, a dispute arises that is subject to the dispute settlement procedure.
    • If a complaint is found to be justified by the entrepreneur, the entrepreneur will, at its option, replace or repair the delivered items free of charge.
  1. Disputes
    • Agreements between the entrepreneur and the consumer to which these general terms and conditions apply are exclusively governed by Dutch law. Even if the consumer lives abroad.
